We Believe in Israel (WBII) has published a new parliamentary briefing, “From Advice to Edict: The Perils of Legislating an ICJ Opinion”, examining the serious constitutional, legal, and economic risks posed by the Bill currently before Parliament that seeks to give binding domestic effect to a non-binding advisory opinion of the International Court of Justice.
The briefing warns that the Bill would:
-
Undermine the UK’s constitutional order by outsourcing elements of foreign policy to unelected international judges.
-
Create sweeping and vague sanctions powers that threaten lawful trade, diplomatic engagement, and UK–Israel cooperation in security, defence, and technology.
-
Expose British businesses to conflicting international obligations, including potential US counter-boycott sanctions.
WBII concludes that existing UK law already provides targeted, lawful tools for responsible foreign policy, and that this Bill would damage British interests while setting a dangerous precedent for external judicial interference in domestic decision-making.
We are grateful to all our partners and collaborators whose expertise, research, and support have contributed to this briefing and to our wider advocacy work.
